1. Who you're contracting with
These terms govern your use of All Of Your Days ("we", "us", "our"), a private, invite-only memory platform. By creating an account or continuing to use the service, you agree to these terms. If you're using the service on behalf of an organisation, you confirm you have authority to bind that organisation. You must be of legal age in your jurisdiction.
2. What the service does
All Of Your Days lets you and people you invite capture, store and view personal memories (photos, videos, text) organised by date across one or more private "timelines". The service is for personal, non-commercial use.
3. Acceptable use
You agree not to:
- use the service for any unlawful purpose, fraud, or spam;
- upload content that infringes anyone's intellectual property or privacy;
- upload illegal content, hate speech, harassment, or sexual content involving minors;
- probe, scan, scrape, or otherwise interfere with the security or operation of the service;
- upload malware or attempt to circumvent technical limits.
4. Your account and content
You're responsible for keeping your account credentials confidential and for activity that happens under your account. You must provide accurate information and keep it updated.
You retain ownership of the content you upload. You grant All Of Your Days a limited licence to host, store, transcode and display your content solely to provide the service to you and the people you invite.
5. Intellectual property
All Of Your Days retains all rights in the service itself, including the software, design, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the service in line with your subscription plan. You may not reverse engineer, resell, or redistribute the service.
6. Payment, subscriptions, refunds and tax
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Subscription fees, billing cycles, renewals, payment methods, taxes and refunds are governed by Paddle's Buyer Terms and our Refund Policy.
7. Service availability
We work hard to keep the service running, but we don't guarantee that it will be uninterrupted or error-free. We may carry out maintenance, add or remove features, or change plan limits.
8. Suspension and termination
We may suspend or terminate your access if you materially breach these terms, fail to pay, create a security or fraud risk, or repeatedly or seriously violate our acceptable use rules. You may cancel your subscription at any time through your account.
When access ends, you'll have a reasonable window to export your content before it is deleted from our systems.
9. Warranties and liability
To the fullest extent permitted by law, the service is provided "as is" without implied warranties. We exclude liability for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. Nothing in these terms excludes liability for fraud, death, or personal injury where the law prohibits such exclusion.
10. Indemnity
You agree to indemnify All Of Your Days against claims arising from your content, your unlawful use of the service, or your breach of these terms.
11. Changes to these terms
We may update these terms from time to time. Material changes will be notified by email or in the app. Continued use after the changes take effect means you accept them.
12. Governing law
These terms are governed by the laws of England and Wales. Disputes will be resolved in the courts of England and Wales, except where mandatory consumer protection laws in your country of residence apply.
