Terms of Service

1. Who you are contracting with

All Of Your Days is operated by All Of Your Days Ltd (Registered in England and Wales, company number 17429195, registered office 94 Rydal Street, Newton-le-Willows, WA12 8JU, United Kingdom). These terms form the agreement between you and us. By creating an account or continuing to use the service, you accept them.

2. Eligibility

You must be 18 years of age or over to create an account or take out a subscription, and you must be able to enter a contract in your country. Accounts and subscriptions are for adults only — a child cannot independently open an account or subscribe. The service is for personal, non-commercial use. If you create an account on behalf of an organisation, you confirm you have authority to bind it.

You may add memories, photographs and information relating to family members of any age, including children. You are responsible for ensuring you have an appropriate right or lawful basis to upload and share content relating to other people, and for respecting their wishes if they ask you to remove it.

3. Your account

You must give accurate information and keep it up to date. Keep your password confidential — you are responsible for activity under your account. Tell us promptly at hello@allofyourdays.com if you think someone else has accessed it. You may sign in with an email and password or with Google.

4. The service

All Of Your Days lets you and the people you invite capture photographs, videos and written memories, organised by date into private timelines. Timelines are invite-only. Members you invite can see the content in that timeline, and contributors can add to it.

5. Free and paid features

There is a permanently free plan with limits on timelines, memories and storage, and paid Premium and Complete plans that raise those limits and add video uploads, bulk upload and timeline search. Current plans, prices and limits are on the Pricing page. We may adjust plan limits and features, and we will tell you about material reductions that affect a plan you are paying for.

6. Subscriptions, renewal and cancellation

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Paid plans renew automatically each month or each year until cancelled. You can cancel at any time from Settings, and cancellation takes effect at the end of the period you have paid for. Billing, taxes, payment methods and refunds are governed by Paddle's Buyer Terms, our Subscriptions & Cancellation page and our Refund Policy.

7. Your consumer rights

Nothing in these terms limits your statutory rights as a consumer under UK law, including your rights under the Consumer Rights Act 2015 and your 14-day right to cancel a distance contract under the Consumer Contracts Regulations 2013. Because the service is supplied digitally and immediately, you agree we may begin supplying it straight away; that does not remove your statutory cancellation rights.

8. Your content

You keep ownership of the photographs, videos and text you upload. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, transcode, resize and display your content solely to operate the service for you and the members you invite. That licence ends when you delete the content or your account, apart from copies that may briefly remain in provider backups.

You confirm that you have the right to upload the content, and that where content shows or describes other people you have their permission (or, for children, the permission of a person with parental responsibility). If a rights-holder or a person in your content objects, contact us and we will act on legitimate requests, which may include removing the content.

We own the service itself, including its software, design, name and branding. We grant you a limited, non-exclusive, non-transferable right to use it in line with your plan. No other rights are granted.

11. Availability and changes

We work to keep the service available and will supply it with reasonable care and skill, but we do not promise it will be uninterrupted or error-free. We may carry out maintenance and change or add features. If we decide to discontinue the service, we will give you reasonable notice and a window to export your content.

12. Suspension and termination

We may suspend or terminate your access if you materially breach these terms, fail to pay, create a security or fraud risk, or seriously or repeatedly break the rules in section 9. Where it is reasonable to do so we will warn you first. You may stop using the service and delete your account at any time.

13. Deleting your account and data

You can delete your account from Settings → Manage privacy & data, which also lets you export a copy of your data first. What deletion removes is described in our Privacy Policy. Deletion is permanent — we cannot restore deleted content.

14. Liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for business losses such as loss of profit or business opportunity. Except where the law does not allow it, our total liability to you is limited to the greater of the fees you paid us in the 12 months before the claim, or £100. We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else where the law prohibits exclusion.

All Of Your Days is not a backup service. Please keep your own copies of irreplaceable photographs and videos.

15. Indemnity (business users only)

If you use the service other than as a consumer, you agree to indemnify us against claims arising from your content or your breach of these terms. This section does not apply to consumers.

16. Changes to these terms

We may update these terms. We will notify you of material changes by email or in the app before they take effect. If you do not accept them you may cancel and delete your account.

17. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK you may also bring proceedings in your home courts, and mandatory consumer protections in your country of residence continue to apply.
